The patent on tapping is a common myth in the tabletop gaming world. The actual patent, US5662332A, included tapping in combination with several other game mechanics that make up MTG in combination with each other. The only way Wizards of the Coast could actually come after you for violating the patent was by making an MTG clone that copied all the major elements of the game included in the patent.
